CREATIVE TERMS

All copyright, design rights, and intellectual property in my designs, creative work, websites, and marketing materials remain the property of Niamh O’Shea / Wylde & Co, unless otherwise agreed in writing. Upon full payment, rights to client-specific deliverables transfer to the client.

Acceptance of Terms

By accepting a quotation or engaging my services, you agree to these terms and conditions. A formal signed agreement is not required — acceptance is confirmed through email or payment.

Contact Details

Working hours are Monday to Thursday, 10:30am–6:00pm (GMT).
I am closed Fridays, weekends, and public holidays.

Rates from:

Hourly: £60
Half-Day (3 hours): £180
Full Day (6 hours): £360
 
Creative exchange is available for aligned projects — contact me if you have something in mind.
 
Out-of-hours work (evenings, weekends, or urgent deadlines) is charged at £100/hour, by prior agreement.

For larger projects, I’m happy to discuss fixed rates, set budgets, or payment plans. A 50% deposit is required to begin, with the remaining balance due before completion or launch.

Late payments may incur interest charges.

Scope of Work and Revisions

A detailed quote will be provided before any work begins. Each project includes up to two rounds of revisions; additional revisions may be subject to extra charges, discussed and agreed in advance. Major changes to the brief may require a revised quote and additional fees.

Client Responsibilities

Clients are responsible for providing content, feedback, and approvals in a timely manner to avoid delays. Final approval is required before any materials are made public.

Project Timeline and Delays

Estimated timelines will be discussed and agreed upon, but delays caused by late client feedback or content submission may impact the schedule.

Collaboration with Third Parties

I may collaborate with trusted freelancers or third-party providers such as photographers, developers, or printers as needed. While I coordinate these collaborations, I take no responsibility for the actions, deliverables, or outcomes directly provided by third parties. Any agreements or warranties with third-party providers are separate from my services.

Termination

Either party may end the project with written notice. Payment will be due for all work completed up to that point. I reserve the right to end a project if the scope changes significantly without agreement, or if communication becomes consistently unprofessional.

Liability

I am not liable for third-party issues or failures. My liability for breach of contract is limited to amounts paid. Clients indemnify me against claims arising from client-provided content.

Confidentiality

All client information is treated confidentially and will not be shared unless legally required.

Additional Costs

Clients agree to reimburse any agreed-upon additional expenses incurred during the project.

Design Credit

A discreet credit may be included on websites I design; removal can be negotiated for a fee.

Refunds and Cancellations

Deposits and payments are non-refundable once work has commenced, as time is reserved exclusively for your project. Cancellation prior to work starting may be eligible for a refund minus any administrative fees or expenses incurred. If cancellation occurs after work has begun, full payment for all work completed and any non-recoverable expenses will be required.

Communication

I primarily communicate via email and scheduled calls, aiming to respond within two business days.

Third-Party Services and Hosting

Hosting, domain registration, and third-party services are typically the client’s responsibility unless otherwise agreed. I am not liable for downtime or issues related to third-party providers.

Dispute Resolution

Any disputes will be handled in good faith with a preference for mediation before legal action.

Force Majeure

Neither party is liable for delays or failure to perform due to causes beyond reasonable control, such as natural disasters, pandemics, or technical failures.
